Terms of Service
Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:

Withdrawal Period: the period within which the consumer may exercise their right of withdrawal.

Consumer: a natural person not acting for purposes related to their trade, business, craft, or profession who enters into a distance contract with the trader.

Day: a calendar day.

Continuing Contract: a distance contract concerning a series of products and/or services for which the delivery and/or purchase obligation is spread over a certain period.

Durable Data Carrier: any medium that enables the consumer or trader to store information addressed personally to them in a way that allows future reference and unaltered reproduction of the information.

Right of Withdrawal: the consumer’s right to withdraw from the distance contract within the withdrawal period.

Trader: the natural or legal person who offers products and/or services to consumers via distance selling.

Distance Contract: a contract concluded within a system organised by the trader for distance selling of products and/or services, using one or more means of distance communication exclusively until the conclusion of the contract.

Means of Distance Communication: a method that can be used to conclude a contract without the consumer and trader being physically present at the same time.

Terms and Conditions: these General Terms and Conditions of the trader.
Article 2 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 30 days without giving any reason.
During the withdrawal period, the consumer shall handle the product and its packaging with care.
If the consumer exercises the right of withdrawal, they shall return the product with all accessories and, if reasonably possible, in its original condition and packaging, following the reasonable instructions provided by the trader.
Article 3 – Scope
These Terms and Conditions apply to every offer made by the trader and to every distance contract and order concluded between the trader and the consumer.
Before the distance contract is concluded, the text of these Terms and Conditions shall be made available to the consumer.
If the contract is concluded electronically, these Terms may be supplied in a way that allows the consumer to store them on a durable data carrier.
If specific product or service conditions apply, those conditions apply alongside these Terms. In case of conflict, the most favourable provisions for the consumer shall prevail.
If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force.
In cases not covered by these Terms, the provisions shall be interpreted in the spirit of these Terms and Conditions.
Article 4 – The Offer
If an offer is subject to a time limit or conditions, this will be explicitly stated.
All offers are non-binding; the trader reserves the right to modify them.
The offer includes a complete and accurate description of the products and/or services.
Images are as true to life as possible, but slight variations in colour may occur.
Obvious errors or misprints do not bind the trader.
Article 5 – Conclusion of the Contract
The contract is concluded once the consumer accepts the offer and meets the stated conditions.
If the consumer accepts the offer electronically, the trader shall promptly confirm receipt of the acceptance.
The trader shall take appropriate technical and organisational measures to secure the electronic transfer of data.
The trader may, before concluding the contract, check the consumer’s solvency or other relevant factors and may refuse an order or attach special conditions to it.
At the latest upon delivery, the trader shall provide the consumer, in writing or on a durable data carrier, with the following information:

address for complaints;

terms and procedure for exercising the right of withdrawal;

warranty and customer service information;
-
the information specified in Article 4 (if not already provided before conclusion of the contract);
-
cancellation conditions for contracts of indefinite or long-term duration.
Article 6 – Right of Withdrawal for Product Deliveries
The consumer may withdraw from the contract within 30 days after receiving the goods.
The withdrawal period begins on the day following receipt by the consumer or a third party designated by the consumer.
The consumer may inspect the goods only to the extent necessary to establish their nature, characteristics, and functioning.
Returns must include all accessories and, where possible, the original packaging.
The withdrawal declaration must be made in writing or by email to the trader.
Article 7 – Costs in Case of Withdrawal
The consumer bears the direct cost of returning the goods.
If the consumer has already made a payment, the trader shall reimburse the amount paid without delay and no later than 30 days after withdrawal, provided the goods have been returned or proof of dispatch has been supplied.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for:
-
goods made to the consumer’s specifications or clearly personalised;
-
perishable goods or goods with a limited shelf life;
-
newspapers, periodicals, or magazines (except subscriptions);
-
audio or video recordings or computer software once unsealed after delivery;
-
hygiene products where the seal has been broken after delivery.
Article 9 – Prices
During the validity period stated in the offer, prices will not be increased except for changes in VAT or other statutory requirements.
Price increases within three months of concluding the contract are only permitted where required by law.
After three months, a price increase requires the consumer’s explicit consent.
Obvious typographical errors do not entitle the consumer to delivery at the incorrect price.
Article 10 – Conformity and Warranty
The trader guarantees that the products comply with the contract, the specifications stated in the offer, and applicable legal requirements.
Additional manufacturer warranties do not affect statutory consumer rights.
Defects must be reported in writing within 30 days of discovery. Returns should, if possible, be made in the original packaging.
No warranty applies for defects resulting from improper handling, unauthorised repair, or abnormal conditions of use.
Article 11 – Delivery and Execution
The trader will take the utmost care in receiving and executing orders.
Unless otherwise agreed, delivery will take place within 30 days.
If delivery is delayed, the consumer will be informed and has the right to withdraw from the contract free of charge.
The risk of loss or damage remains with the trader until the goods are delivered to the consumer.
Article 12 – Duration Contracts: Term, Termination, and Renewal
Consumers may terminate contracts of indefinite duration at any time with a notice period of no more than one month.
Fixed-term contracts end automatically; renewal is only possible with the consumer’s explicit consent.
Automatic renewal of newspaper or magazine subscriptions is permitted only under statutory exceptions.
Contracts lasting more than one year may be terminated by the consumer after one year, with a maximum notice period of one month.
Article 13 – Payment
Unless otherwise agreed, payment must be made within 7 days after the start of the withdrawal period.
For services, payment must be made within 7 days after confirmation of the contract.
Incorrect payment details must be corrected immediately.
In case of late payment, the trader may charge reasonable, pre-notified administrative or collection costs.
Article 14 – Complaints Procedure
Complaints must be submitted in writing within 7 days after discovery.
The trader will respond within 14 days of receipt.
If a complaint cannot be resolved immediately, the consumer will receive an acknowledgement and an estimated timeframe for resolution.
If the dispute cannot be settled amicably, the consumer may initiate a mediation or dispute resolution procedure.
A justified complaint will result in repair, replacement, or refund at no cost to the consumer.
Article 15 – Disputes
All contracts between the trader and the consumer are governed exclusively by the laws of the Netherlands, even if the consumer resides abroad.
